Welcome to Jolly Green Tours! These Terms and Conditions outline the agreement between you ("the User" or "Client") and Jolly Green Tours ("we," "us," or "our") regarding your use of our website (jollygreentours.com) and the booking and participation in our tours.

By accessing, browsing, or using our website, or by booking any of our tours, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety. If you do not agree to these terms, please do not use our website or services.

1. General Information

Starting Point: Unless explicitly stated otherwise in your booking confirmation, all tours depart from designated meeting points in Porto Alegre or the specified region. Please arrive at least 15 minutes before the scheduled departure time.

Vehicles & Transportation: Transportation is provided in modern, air-conditioned, fully insured, and commercially licensed tourist vehicles appropriate for the group size.

Pick-up & Drop-off: Hotel pick-up and drop-off services are available only for designated tours and specific service areas as described during the booking process.

Languages: Tours are conducted in English, Portuguese, or Spanish as selected during booking. Bilingual or multilingual guides are provided based on tour availability and request.

Exclusions: Personal expenses, discretionary gratuities, meals and beverages (unless specified), travel insurance, and optional activities not listed in the itinerary are not included in the tour price.

2. Bookings and Payments

Direct Bookings: Bookings made directly through our website require full payment or the agreed deposit at the time of reservation to secure your spot.

Payment Methods: We accept major credit cards (Visa, Mastercard, American Express, Elo, Hipercard), PIX, and authorized secure online payment processors.

Promotional Codes: Promo codes and discounts must be applied at the time of booking and cannot be applied retroactively to confirmed reservations.

Pricing & Availability: All prices are subject to change without prior notice until a booking is confirmed. Prices include all applicable local taxes unless explicitly stated otherwise.

Currency: Transactions are processed in Brazilian Reais (BRL) or US Dollars (USD) as displayed at checkout. Currency conversion rates and foreign transaction fees may be applied by your issuing bank.

Receipts & Invoices: An electronic booking confirmation and receipt (Nota Fiscal de Serviços Eletrônica - NFS-e) will be issued and emailed upon successful payment processing.

3. Cancellations and Refunds

Client Cancellations:

  • Standard Policy: Full refund for cancellations made at least 24 hours prior to the scheduled tour start time. Cancellations made within 24 hours of departure are non-refundable.
  • Right of Withdrawal (CDC Art. 49): In accordance with the Brazilian Consumer Defense Code, for online purchases, clients may exercise the right of withdrawal within 7 (seven) calendar days from the purchase date, provided the tour has not already taken place.

Company Cancellations: If we must cancel a tour due to severe weather, safety concerns, or unforeseen operational circumstances, you will be offered a full refund or the option to reschedule to another date.

No-Shows: No refunds will be provided for late arrivals, missed departures, or failure to attend a scheduled tour.

4. Use of the Website

Acceptance: By accessing our website, you agree to comply with all applicable local, national, and international laws and regulations.

Modifications: We reserve the right to modify, suspend, or discontinue any aspect of our website or services at any time without prior notice.

Authorized Use: You may use our website solely for legitimate inquiries, bookings, and personal travel planning.

User Accounts: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

User Responsibility: You agree to provide accurate, current, and complete information during registration and booking processes.

Personal & Non-Commercial: Content on this website is for personal, non-commercial use only. Commercial exploitation without prior written consent is strictly prohibited.

Termination: We reserve the right to restrict or terminate access to our website or cancel accounts for any violations of these Terms.

Prohibited Activities: You agree not to:

  • Personal injury, illness, or medical emergencies not directly caused by our gross negligence
  • Delays, schedule changes, or disruptions caused by weather conditions, traffic, roadblocks, or public events
  • Acts, defaults, or omissions of third-party suppliers, including venues, restaurants, and activity providers
  • Force majeure events and circumstances beyond our reasonable control

Our total aggregate liability for any claims arising out of or related to our services shall not exceed the total amount paid by the client for the specific tour giving rise to the claim.

Consumer Protection: Nothing in these Terms shall limit or exclude statutory rights guaranteed under the Brazilian Consumer Defense Code (Law 8.078/90) that cannot be waived by contract.

Third-Party Services: When booking experiences, tickets, or transport operated by third-party partners, the terms and conditions of those respective operators will also apply.

Force Majeure: We are not liable for any failure or delay in performance resulting from acts of God, extreme weather, civil unrest, government actions, pandemics, or other events beyond our reasonable control.

Website Availability: We do not warrant that our website will be uninterrupted, secure, or error-free at all times.

7. Data Protection & Security

We take the protection of your personal information seriously and maintain technical and administrative measures to secure your data.

8. Passports, Identification & Insurance

Identification Requirements: All participants must carry valid official photo identification (Passport or national ID card / RG / CNH) on all tours, as required by Brazilian law for tourist transportation.

Travel Insurance: Basic vehicle occupant insurance is provided during transit. However, we strongly recommend that all international and domestic travelers obtain comprehensive personal travel, health, and baggage insurance.

9. Governing Law and Jurisdiction

Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil.

Consumer Rights (CDC): Brazilian Consumer Defense Code (Law 8.078/90) provisions apply to all consumer relationships established between clients and Jolly Green Tours LTDA.

Dispute Resolution & Forum: Any disputes arising from or in connection with these terms shall be submitted to the exclusive jurisdiction of the Courts of the Judicial District of Porto Alegre, State of Rio Grande do Sul, Brazil, with express waiver of any other forum, however privileged.
